Why Does Erik Menendez Believe He Should Have Been Arrested The Night Of The Murders?

Erik Menendez admits there was a mountain of evidence against him the night of the murders. The Beverly Hills police received a frantic 911 call from Lyle Menendez on August 20,1989, claiming that his parents had been murdered. Lyle and his brother Erik claimed to have been at the movies while their parents were shot and killed in their TV room by intruders.

Erik, who is now featured with his brother in the Netflix Series Monsters: The Lyle and Erik Menendez Story. Erik suggests that he and his brother should have been arrested immediately that night.

The brothers have once again gained national recognition through the series published by Ryan Murphy. In the series, the motives behind the crimes were explored.

Menendez details the evidence that should have led to their arrests. Erik and Lyle remain incarcerated at California’s Donovan Correctional Facility.

Erik reflects in his calls with director Alejandro Hartmann, evidence that points directly at them as their parents killers. Erik says there should have been a police response and they would have been arrested.

Erik stated, “We had no alibi. The gunpowder residue was all over our hands. Under normal circumstances, they give you a gunpowder residue test and we would have been arrested immediately.” There was even gun shells in Erik’s car and their emotional state should have been a red flag.

Erik admits that he would have crumbled under questioning that night. “I was in a completely broken and shattered state of mind.” Erik suggests that this would have quickly led to a confession.

In March 1990, seven months after the murders, Lyle and Erik were arrested and charged with their parents murders.

Some were very shocked that it took this long considering how prominent their family was in the area and the wealth of evidence against the boys that had existed from the very start.

Not only did the case immediately get national attention, it took two trials before Lyle and Erik were convicted of first degree murder. The first trial ended in a mistrial while the second resulted in both of them receiving a life sentence without the possibility of parole.
