Amber Heard Challenges ‘Chilling’ Johnny Depp $10M Verdict, Offers New Options!

Amber Heard continues to battle the verdict in her war with Johnny Depp. And her new efforts come just weeks after Depp filed his appeal of some aspects of the verdict. But because the actress entered her own brief, the former couple’s legal battle shows no sign of ending.

Scolding trial court Judge Penney Azcarate, Amber Heard’s attorneys challenged the verdict in a new brief in the Virginia courts. And those attorneys feel that the trial court made errors. “The trial court erroneously refused to dismiss this action on the ground of forum non conveniens, based on its mistaken conclusion that Depp’s claims arose in Virginia because the Washington Post’s servers are located here,” stated Jay Ward Brown and David L. Axelrod in the court documents via Deadline.

However, the lawyers also found more reasons to contest the verdict. And they claimed that “the trial court also erred in overruling Heard’s demurrer.” Amber had “argued that the challenged statements are non-actionable expressions of opinion and are not reasonably capable of conveying the alleged defamatory implication,” noted the attorneys. But they also issued a warning about the impact on other women.

“That holding, if allowed to stand, undoubtedly will have a chilling effect on other women who wish to speak about abuse involving powerful men,” added Heard’s lawyers. And the appeal slams Judge Azcarate for the instructions given to the jury. It claims that the verdict left out “highly probative evidence” and admitted “irrelevant and prejudicial evidence.” 

Amber Heard – Offers Two New Options Via Attorneys

As a result of Heard’s views, her lawyers offered two options. First, they recommended that the $10 million verdict against her get reversed. And second, if that failed, Amber’s attorneys requested that the verdict be trashed and a new trial arranged.

But the lengthy brief also argued that the case shouldn’t even have gone to trial. “This case also should never have gone to trial,” claimed the brief. “Because another court had already concluded that Depp abused Heard on multiple occasions. After Depp filed this case, the United Kingdom High Court of Justice ruled in a separate defamation action brought by Depp that Heard’s abuse allegations were true.”

The on-going legal war began when Amber penned a Washington Post op-ed. In her essay, she described herself as a woman who represented domestic abuse. And though Heard did not mention Depp in the op-ed, the actor claimed that she had destroyed his career. As a result, Johnny sued Amber for $50 million.

And Depp has asserted that he represents the victim in the relationship. But though he won, Johnny also filed an appeal over the $2 million that Heard received in a counter-suit claim. However, except for that counter-claim, the highly watched case awarded Depp $10 million in compensatory damages and $5 million in punitive damages.

As a result of both Amber and Johnny now filing appeals, a group of judges will evaluate the cases. And if that doesn’t turn out as either desires, it could go to the Commonwealth’s Supreme Court. As a result, experts predict that years could pass before the battle between the exes ends.
