Anne Heche’s Son, Homer Laffoon Disputes The Legality Of Her Will With Her Ex

The legal battle is mounting following the tragic death of Anne Heche over the multi-million dollar estate she left behind. The actress’ eldest son Homer Laffoon is locked in a court case with her ex James Tupper over who should have control of her estate.

Anne Heche’s Will – Or Lack Of It – Is Causing Tension Between Her Loved Ones

I imagine it won’t be fun for anyone to leave the world behind and have their loved ones squabble over property. But it’s this unfortunate event that’s engulfing the family that Anne Heche has left behind.

According to court documents, Homer Laffoon, whom the late Anne Heche shared with her ex-husband Coleman Laffoon, has updated his previous court filing with 9 extra pages providing further details about his petition to assume control of his mother’s estate.

Homer, 20, accused his late mother’s ex of blocking communications between him and his 13-year-old half brother Atlas Heche Tupper, following her death in August.

Homer also claimed that a 2011 document, which Tupper presented as a will – and which states that the control of Anne’s estate falls to him after her death – is not valid because the signature was not his late mother’s and the will was not observed by two witnesses as required by the law.

Per Tuesday’s filing: “Mr. Tupper repeatedly refers to the email attached to the Objection as a ‘will.’ However — as a matter of law — the email does not qualify as either a holographic will or formal witnessed will,” the document reads. “The email fails to satisfy the legal requirements for a valid holographic will because the material provisions of the purported will are not in the handwriting of the Decedent. A will is valid as a holographic will, whether or not it is witnessed, if the signature and the material provisions are in the handwriting of the testator.”

The filing continues, “The email presented to the Court as Decedent’s ‘will’ by Mr. Tupper fails to meet the requirements for a valid holographic will because the signature and material provisions are not in the handwriting of the Decedent. The email fails to satisfy the legal requirements for a valid formal witnessed will because the email was not signed by the Decedent and does not have two witnesses who signed the document during the lifetime of the Decedent.”

The document then points out that in the absence of a proper will “there can be no nomination of an executor” or an executor selected, in general. The legal papers then explains that this role is important as the executor “is appointed to administer an estate pursuant to a valid will.”

Tupper also pushed back with his own claims, notably saying that Homer was estranged from his mother before she died. The accusation has been termed as “inaccurate and unfounded” by Homer.
