DA Accuses Menéndez Brothers of Lying, Moves to Block Resentencing

Lyle and Erik Menéndez are both serving a full life sentence in prison without parole for murdering their parents, Jose and Kitty Menéndez.
Their case was brought to the spotlight last year with the release of Ryan Murphy’s ‘Monsters,’ leading to increased interest on the brothers’ case.
However, the hopes of fans, family and friends, and the brothers especially, seem ready to be dashed after the DA made a strong argument as to why they should never be released.
Los Angeles County District Attorney Doesn’t Want Lyle and Erik Menéndez To Get Out of Jail
The Menéndez brothers’ case has garnered both critics and supporters in the years after they walked into their father’s California mansion and emptied bullets inside the Hollywood executive and his wife.
At the time, the brothers’ pled that their actions were a means of self-defense, as their father had sexually assaulted them as children and then threatened to kill them when they confronted him about it as adults. Their mother was accused of being in silent support of his actions. To this, the Los Angeles District Attorney calls bullocks.
“Our position is that they shouldn’t get out of jail,” Hochman said at a news conference Monday. “We bring that position to the court. The court can agree with it, the court can disagree with it or modify it in some respect.”
In addition to this, Hoffman revealed that his office is “prepared to go forward” with the hearing regarding their resentencing case. The hearing will take place on March 20 and March 21.
Hochman further argued that since the “brothers persist in telling these lies for the last over 30 years about their self-defense defense and persist in insisting that they did not suborn any perjury or attempt to suborn perjury, then they do not meet the standards for resentencing. They do not meet the standards for rehabilitation.”
“If the Menendez brothers, at some point, unequivocally, sincerely and fully accept complete responsibility for all their criminal actions, acknowledge that the self-defense defense was phony and their parents weren’t going to kill them … and finally come clean with the court, with the public, with the DA’s office, with their own family members and acknowledge all these lies … in the future, the court can weigh these new insights into making a determination as to whether they now qualify for rehabilitation and re-sentencing. And the [DA’s office] will do the same,” Hochman said.
Hochman revealed that he arrived at his decision after reviewing trial transcripts, prison records and videotaped trial testimony, as well as meeting with Menendez family members, defense attorneys and past prosecutors.
Another thing that did not sit well with Hochman was how the brothers carefully orchestrated the whole thing to make sure the police did not trace the murders to them.
He noted that on the night before the murders the brothers had driven out to San Francisco to buy guns using fake IDs and had then bought movie tickets to plant their alibi.
He also talked about the meticulous way they cleaned the crime scene of fingerprints to make sure nothing could be traced back to them.
