In a video footage obtained by TMZ, Hayden and Brian were seen outside the restaurant of Sunset Marquis with a group of people in a heated discussion, which no sooner resorted to flying fists and throwing punches. In the heat of the fight, Hayden was kicked and was heard yelling “Brian, Jail!,” possibly to warn to Brian not to fight, as he’s on probation.
Hayden’s representative, in an exclusive statement to PEOPLE, explained the cause of the fight. The fight reportedly began as a result of Brian telling someone something about tipping the waitress poorly while he and Hayden were still inside the restaurant of Sunset Marquis. The person he made the comment to, together with the people he was with, harried and shoved Brian. It took the security pushing them out of the building to keep the fight from creating chaos in the eatery.

Hayden began dating Brian in 2018 after it was rumored she broke up with her then-fiancé Wladimir Klitschko whom she shares her 7-year-old daughter, Kaya, with.
The incidents that led to Brian doing time behind bars began around May 2019 to January 2020. Brian was first arrested in May 2019 on grounds of Domestic violence.
The felony complaint arranged by PEOPLE at the time said that prosecutors alleged that Brian “willfully inflicted corporal injury resulting in a traumatic condition” on Hayden.
Later that month, Brian pleaded not guilty to one count of domestic violence. Around September 2019, the case was dismissed. A spokesperson for the Los Angeles County District Attorney’s Office said at the time, “Our office was unable to proceed because we could not secure a material witness.”
On 14th of February 2020, Brian was once again arrested and charged with domestic battery and interference with a cop for misdemeanor in Jackson, Wyoming. It was alleged that Brian punched Hayden on the right side of her face. Brian pleaded not guilty to the charge on April of 2020.
That same year, in the month of June, according to the criminal complaint obtained by PEOPLE, Brian tried to “prevent and dissuade Hayden Panettiere, a victim and witness of a crime from causing a complaint, indictment, information, probation and parole violating to be sought and prosecuted and assisting in the prosecution thereof.”
Brian Hickerson was sentenced in April 2021 to 45 days in jail after pleading no contest to two felony counts of injuring a spouse/cohabitant/girlfriend/child’s parent, the Los Angeles District Attorney’s Office confirmed to PEOPLE at the time. He served his sentence from May 7 through May 20, jail records show.
In addition to his jail time, Brian was sentenced to four years of formal probation, 52 domestic violence classes, $500 in restitution and a five-year protective order for injuring Panettiere.
Hayden Panettiere – Is Hayden Panettiere Still Seeing Brian Hickerson Even After What He Did To Her?
When Brian was back from serving his jail term, which he served from May 17 through May 20, Hayden was spotted with him on one of many occasions around July 2021. A spokesperson for the Los Angeles District Attorney’s Office previously told PEOPLE that Brian’s sentence does not prohibit him and the victim from amicably interacting with each other.
A source told PEOPLE at the time that Brian is “in intensive therapy treatment.” The insider added: “Hayden won’t forget what he did but she wants to forgive and move on. Hayden is sober and doing very well.”
Brian told E! News that he and Hayden were “working on a friendship.”
