Judge Puts Brakes on Menéndez Brothers' Resentencing, Blocking Possible Immediate FreedomRyan Murphy’s ‘Monsters’ brought Lyle and Erik Menéndez’s story back to the spotlight. At the height of all this, the brothers received significant media coverage that they gained fans that support the idea that the brothers should be granted freedom, especially since they’ve already spent over three decades of their life behind bars for the 1989 murder of their parents.

However, public support was likely not going to get them somewhere. What might is the new evidence that was discovered a few years ago that Erik did communicate their father’s tendencies to sexually assault them to a close cousin.

This may be the game changer they’d no doubt have hoped on, but they will have to wait a little longer to see if parole, at the very least, is for them.

Menéndez Brothers’ Legal Team To Spring For Manslaughter Charges In Resentencing Case

The Menéndez brothers would have finally had their chance to have a judge review their case and determine whether they’ve been rehabilitated enough to rejoin society this week.

This week would have seen their attorney Mark Geragos ask the county judge Michael Jesic to reduce Erik and Lyle Menendez’s charges to manslaughter. If this happens, they would qualify for immediate release from prison.

However, the brothers were up for another disappointment when, after hearing the points made by the defense and prosecution, judge Michael Jesic chose to delay the proceedings. Something tells me the brothers would be used to these little disappointments by now.

“Today was a little bit disappointing for us as a family,” Anamaria Baralt, the brothers’ cousin, told NBC Los Angeles. “There have been some delays in this process that were unforeseeable, like the wildfires, that, of course, we have great patience for. This is another delay that is not so much, but we will continue to show up as a family.”

If there was ever a time for the brothers to win their freedom back, it was now. What with public support being what it is, recommendation from the former Los Angeles district attorney’s that the brothers be resentenced, and a decision from the governor to order the parole board to determine whether they would pose a risk to the public if they were released.

There’s a thorn on their side though: Gascón’s successor, Nathan Hochman, would rather they serve their full life sentence and has made moves to block their resentencing petition.
