Kim Kardashian’s latest criminal justice reform effort has landed her in legal trouble. The reality star and entrepreneur is being sued by a New York man, Ivan Cantu, after she mistakenly used his photo in an Instagram post meant to advocate for a Texas death row inmate with the same name.
The mix-up, which quickly spread due to Kardashian’s massive following, has led to claims of emotional distress, reputational damage, and negligence.
A Case of Mistaken Identity
In February 2024, Kardashian urged her followers to sign a petition protesting the execution of Ivan Abner Cantu, a Texas inmate convicted of double murder.
However, instead of using a verified image of the prisoner, her team mistakenly uploaded a publicly available photo of another Ivan Cantu—a New York-based project manager with no connection to the case.
The mistake caused immediate confusion. The wrongly identified Cantu was bombarded with messages from friends and family who feared he was on death row. In response, he took to Facebook to clear up the misunderstanding, writing:
“To all my friends and family, I am not getting executed. Some idiot who runs @kimkardashian used my picture instead of Ivan ‘Abner’ Cantu.”
Emotional and Psychological Impact
Cantu alleges that the misidentification triggered significant emotional distress, forcing him to deal with anxiety, insomnia, nightmares, and even symptoms resembling PTSD. His attorney, Greg Sobo, emphasized the emotional toll, stating:
“When this happened, Ivan Cantu was in a very private time in his life. He had suffered a serious family loss, and was in a grieving period, and did not want to be interacting with people. And then this comes in and destroys his privacy at a sensitive and critical time for him.”
According to Sobo, Cantu has been undergoing treatment since the incident. The lawsuit seeks damages for libel, slander, invasion of privacy, and emotional harm.
Legal Battle and Kardashian’s Defense
The lawsuit, filed in Los Angeles Superior Court, argues that Kardashian’s actions were not just negligent but reckless, stating that her post was published “without privilege or authorization” and violated “standards of ethics and decency.”
Despite the swift deletion of the post, Cantu’s legal team argues that the damage had already been done. Given Kardashian’s influence and audience size, the false association with a convicted murderer spread quickly, leaving a lasting impact.
Kardashian’s attorney, Michael Rhodes, defended her actions, describing the error as an unfortunate but honest mistake:
“It was a simple error of using a publicly available photo of another individual with the same name to promote Kim’s longstanding commitment to criminal justice reform. The image was taken down immediately once the mistake was realized.”
While Kardashian’s team hopes to resolve the matter without legal escalation, Rhodes made it clear they are prepared to defend her in court if necessary.
The Risks of Social Media Advocacy
This case raises broader concerns about accountability on digital platforms. Kardashian, who has been a vocal advocate for criminal justice reform, has successfully used her platform to highlight wrongful convictions in the past.
Her involvement was instrumental in securing clemency for Alice Johnson in 2018, after lobbying then-President Donald Trump.
However, this incident serves as a reminder that even well-intended activism carries risks, especially when dealing with sensitive legal matters.
Sobo, Cantu’s lawyer, stressed the need for caution in using social media for advocacy, stating:
“We know social media can do so many good things, but if it’s abused, it can really cause injuries. Kim Kardashian should be held accountable for it. It’s an inexcusable thing that she did, and she really hasn’t taken full accountability for it.”
What Happens Next?
As the lawsuit moves forward, it remains to be seen whether Kardashian will reach a settlement or face a legal battle in court. Either way, the case has sparked important discussions about the power and responsibility that come with having a massive online presence.
For Cantu, the ordeal has been deeply personal. His legal team argues that Kardashian’s mistake turned his life upside down at a moment when he was already vulnerable.
Now, through this lawsuit, he is seeking accountability—not just for himself, but as a statement on the responsible use of social media by public figures.
