General Hospital Spoilers – Sam McCall Has Been In Pentonville Prison Awaiting A Bench Trial
Thanks to the feds coming in and deciding that the Haunted Star was in their jurisdiction, and not Port Charles New York’s, Sam has been in Pentonville Prison awaiting a bench trial, and Attorney Diane Miller (Carolyn Hennesy) has every confidence that she can win the case, and will defend Sam masterfully! She has checked the court calendar and is sure that the judge she is hoping for will be the one to rule in Sam’s case.
Sam opted for a bench trial rather than a jury trial because of the speedier process, and it is the judge alone who considers the evidence in a bench trial and the guilt or innocence of the defendant. Diane is sure she can get the testimony of Nurse Sherri Cottle (Jerin Forgie) disregarded since it could fall under the classification of no hearsay since she was eavesdropping on a private conversation.
She also has the forensics both from the audio forensic department of the Port Charles Police Department and Damian Spinelli (Bradford Anderson), which proved the recording that Daisy Kwan (Kelsey Wang) brought in as evidence of pre-meditated murder of Shiloh Archer (Coby Ryan McLaughlin) was edited together from clips! What could go wrong?
GH Spoilers – Defense Law Vs Murphy’s Law: Which One Will Win?
Of course, Murphy’s Law states that if anything can go wrong, it will! In a bench trial, there is no jury, but there is still a prosecuting attorney who is usually the district attorney – in Port Charles’ jurisdiction, it is District Attorney Robert Scorpio (Tristan Rogers). However, since the Feds stepped in and took over the case since they claimed the Haunted Star was in international waters when Shiloh was killed, it won’t be Robert that Diane will be up against in all likelihood – it will be a FEDERAL prosecutor.
Since General Hospital spoilers say the trial will take place, there will probably not be a change of venue – to a federal courthouse – although if this were to happen in real life there probably would be. But there IS a DISTINCT possibility that a FEDERAL JUDGE may be assigned, and NOT the judge that Diane was certain will preside! It is also possible that the trial COULD be moved to a federal courthouse if there is one in Port Charles. Federal courthouses, if there are not many federal cases tried in a particular jurisdiction, are sometimes combined with US Post Offices!
General Hospital Spoilers – Attorney Diane Miller Could Lose The Case If It is A Different Judge
Attorney Diane Miller could lose Sam’s case if the judge is a different judge than she expected, and although it is possible she could ask for a continuation, (the court to be rescheduled for a later date) Sam would not want to and she would still get a different judge if the Feds demand a Federal judge. If she loses the case, Sam indeed would be shaken, and everyone who loves her as well!
