Gabby Petito’s Mom Files New Lawsuit Of $30K  Against Brian Laundrie’s Estate

Gabby PetitoGabby Petito’s case garnered national attention in September 2021 when the aspiring YouTuber was declared missing while on a cross-country road trip with Brian Laundrie, her fiancé, who had returned home to Florida alone, in her van. 

On May 6, the Mom of the deceased Gabby Petito whose name is Nichole Schmidt, filed a new wrongful death lawsuit in Florida against the estate of deceased Brian Laundrie. The lawsuit as obtained by Fox News seeks damages of at least $30,000. The complaint claims that Laundrie murdered Petito, and as a direct result, Nichole and Gabby’s father, Joseph Petito, “incurred funeral and burial expenses, and they have suffered a loss of care and comfort, and suffered a loss of probable future companionship, society, and comfort.”

Laundrie’s attorney Steven Bertolino said in a statement on May 6 that the lawsuit was expected from the Petitos: “The filing of the wrongful death lawsuit by the Petito family was fully expected,” Bertolino said. “This lawsuit will most likely not be defended and the Petitos will have gained nothing more than a piece of paper that tells them what everyone already knows—which is that Brian was responsible for Gabby’s death as indicated by the FBI.”

Gabby Petito – How She Was Discovered Dead

Gabby is a 22-year-old travel blogger who vanished in late August while on a road trip with her boyfriend Brian Laundrie, 23. Petito’s family had reported her missing on Sept. 11, 10 days after Laundrie had returned to his parent’s home in North Port, Florida without her.

On September 19, Gabby’s remains were discovered at a camping area in Bridger-Teton National Forest in Wyoming. Her cause of death was ruled a homicide due to “blunt-force injuries to the head and neck, with manual strangulation.” 

At the time, Brian and his parents, Chris and Roberta Laundrie, did not share any information with law enforcement and referred officials to their attorney. Brian later disappeared during the investigation. After a month-long search, Brian was found dead in Myakkahatchee Creek Environmental Park in North Port, Fla., where his parents believe he went the last time they saw him on Sept. 13. Personal items belonging to Laundrie were discovered near his remains including a notebook in which claimed “responsibility” for Petito’s death.

Gabby Petito – Gabby’s Case To Become Lifetime Movie

Gabby Petito’s case has been greenlit to become a Lifetime movie as part of the network’s “Stop Violence Against Women” public affairs initiative. Lifetime announced the upcoming film entitled “The Gabby Petito Story” on Thursday, noting in a statement that the “anniversary of Gabby Petito’s disappearance and murder approaching this fall.”

Actor Thora Birch, known for her iconic roles in classics like “American Beauty” and “Ghost World” will direct “The Gabby Petito Story” in her directorial debut. She will also star as Gabby’s mother Nicole Schmidt.

“The Gabby Petito Story will explore Gabby and her fiancé Brian Laundrie’s complicated relationship and what may have gone wrong during their cross-country trip that resulted in Gabby’s tragic murder,” the Lifetime press release states.

A PSA providing resources on domestic violence will debut along with the movie, Lifetime has announced.

“As a trusted destination for women, Lifetime will create a new PSA to debut as part of the movie’s rollout, driving to the important work of the network’s coalition of partners to provide resources for women,” they state. “Being a leader in telling powerful stories of women and providing a platform to shine a light on unheard voices, Lifetime is also in development on several movies surrounding violence against women who may not have had the same media attention as Gabby Petito. These include the stories of Carlesha Freeland-Gaither, Adriane Fields, and Beatrice Weston, among others, with each project in various stages of development.”

The film will be shot in Utah this summer and then “premiere later this year.”
