Josh Duggar Denied A Retrial For Possessing Child Porn

Josh Duggar faces his sentencing for downloading and possessing child porn. Arrested just over a year ago, he ended up in a long trial that began in November last year. After the former 19 Kids and Counting star was found guilty, his legal team started their process to file for a retrial, an acquittal, or a reduced sentence. Well, over the weekend, hopes that another trial could take place came to an end.
Josh Duggar – Prosecution Wants A Long Sentence
TLC fans who are familiar with the background of Josh molesting his younger sisters want to see him jailed for the rest of his life. Well, that probably won’t happen, given the limitations of the courts. Still, he faces a very substantial prison sentence. In fact, the Probation report suggested that he’s not able to rehabilitate and that the chances of reoffending are high. That never stopped the defense from arguing his innocence.
Josh Duggar’s wife Anna pleaded with the judge for a lenient sentence. So did his mom, Michelle. In the meantime, his legal team also argued for a reduced sentence. Additionally, they wanted a retrial, if not an acquittal. From their side, they claim that the state didn’t make a firm argument that someone else might have committed the offense. Of course, those who hate Jim Bib Duggar also felt that he always pushed things under the rug, and his parents didn’t do enough to protect their daughters.
Josh Duggar – Retrial Denied By Judge
One argument that came up, is that the feds couldn’t prove that it was actually Josh who opened and viewed the child porn on his computer. That didn’t fly. Neither did the argument that an employee or someone else somehow downloaded the offensive content. Potentially, without a retrial, Josh will face prison time for anything between seven to 20 years.
The KWNA Fox 24 news website reported on May 24, that Josh Duggar lost his fight for a retrial. The outlet wrote, “In a 29-page ruling handed down in the Western District of Arkansas Federal Court in Fayetteville, Duggar’s request for an acquittal or a new trial was denied.”
Josh Duggar – The Sentencing Goes Ahead
Josh Duggar will hear his sentence on May 25. Clearly, he stands little chance of getting off lightly or further delays while more filings go on.

The outcome of the retrial or acquittal hearing said: “… there is no merit to Mr. Duggar’s argument in favor of acquittal. There was significant evidence presented at trial to convince a reasonable jury that Mr. Duggar was physically present during the offense conduct… Accordingly, his request for relief under rule 29 is DENIED.”
