Meghan Markle Loses Latest Court Fight – “Finding Freedom” Can be Used In Legal War With Tabloids

Meghan Markle has had a pretty big setback in her court case against Associated Newspapers, the parent company of a couple of British Tabloids that published a personal letter the duchess had written to her estranged father.
Originally, Meghan fought to keep the contents of Omid Scobie and Carolyn Durand’s “biography” of the Sussexes from being used by lawyers for the opposing side. However, the judge in the case has now ruled that since either Meghan or Meghan’s friends cooperated with the authors of “Finding Freedom,” the book’s contents are fair game and can be used as evidence.
For those who don’t know, Meghan Markle’s lawsuit is one that accuses Associated Newspapers of violating her privacy under Europe’s Data Protection Act. According to the accused, Meghan allowed details of her letter to Thomas Markle along with her feelings concerning the letter’s publication to be published in Finding Freedom. The reason for Meghan’s actions, again according to the lawyers for Associated Newspapers, was “in order to set out her own version of events in a way that is favorable to her”.
The Judge Doesn’t Buy Meghan Markle’s Argument
Despite the best efforts of Meghan Markle’s attorneys, Judge Francesca Kaye didn’t buy Meghan’s story. In the judge’s view, allowing the contents of Finding Freedom to be presented does not add “new defenses” but instead allows the newspaper’s lawyers to zoom in on particular details relevant to the case at hand.
Following Judge Kaye’s ruling, Team Markle evidently wanted to appeal. As Meghan’s lawyer, Mr. Rushbrooke wrote, “The claimant and her husband did not collaborate with the authors on the book, nor were they interviewed for it, nor did they provide photographs to the authors for the book.”
However, the judge also denied Meghan’s request on that front. Apparently, the argument of Associated Newspaper’s attorneys was quite convincing when they wrote concerning Finding Freedom that there was, “every appearance of having been written with their (Meghan Markle and Prince Harry’s) extensive co-operation.”
With that said, even though Judge Kaye denied a request for appeal, sources suggest that Meghan’s lawyers can still appeal directly to the court of appeals.
Meghan Has Spent A Lot Of Money On Her Lawsuit
Insiders say that Meghan must be frustrated with how her lawsuit against Associated Newspapers is going considering the fact that she has paid quite a lot of money in legal fees. Indeed, reports indicate that Meghan Markle has spent up to £1.8 Million. In contrast, the defendant in Meghan’s case has only spent £1.2 Million and the newspaper likely has much greater resources at its disposal than the duchess.

An interesting note is that Omid Scobie was required to submit a written statement that Meghan Markle did not participate in the writing of his book, Finding Freedom. This means that Mr. Scobie may be required to testify at some point during court proceedings. What Meghan’s chances of winning the case are at this point is still anyone’s guess.
