Royal Expert Says Private London Clinic Could Be Forced To Pay A Hefty Sum For Breaching the Princess of Wales’ Privacy
On January 16, Kate was admitted to a London Clinic to undergo a planned abdominal surgery. Following the surgery, the Princess stayed a few days at the hospital so that her condition could be monitored.
When she left the hospital, Kensington Palace revealed that she would be out of the spotlight as she recuperates and that her earliest engagement will come after the Easter holidays.
Even with a statement as clear as this, it did not stop the whereisKate hashtag from trending just a few weeks later. Well, the question to know where Kate is has gotten more enthusiastic and it may cost a London Clinic a lot of money as a result.
Per reports, at least one hospital staff tried to access her notes while she was a patient there, and this violates the Data Protection Act 2018, which states that it is an offence for a person to obtain, disclose or retain personal data without the consent of the data controller.
The Princess of Wales has reportedly been informed of this attempt and an investigation launched, with certain members of staff under investigation.
Speaking on the issue to The Sun, medical expert Iain Wilson, from Brett Wilson LLP, said that the clinic stand to lose a lot of money if they should ever be sued by Kate.
He said: “They’ve obviously got obligations to keep medical records secure through the Data Protection Act. If it is found they didn’t have sufficient systems in place, for instance, they hadn’t trained staff properly, then they could be fined by the information commission officer.”
He added: “A very large sum, I think up to £17.5million or 4 per cent of an organisation’s annual worldwide turnover and potentially sued by the individuals in question.”
At the moment, we only know there’s been an attempt to access the Princess’s records, but we don’t know whether it was successful or not.
