90 Day Fiance’ Spoilers – Deportations Have Been Suspended

90 Day Fiance’ deals with a lot of people from different countries who want to marry United States citizens. Several of these people come from Ukraine and other countries often associated with poverty or communistic practices. However, the Biden administration has suspended deportations flights to not only Ukraine but Russia and seven other European countries due to the Russian invasion of Ukraine.

In a statement issued recently, U.S. Immigration and Customs Enforcement (ICE) confirmed a suspension of deportation flights to Ukraine. An agency spokesperson told CBS News, “Amid the ongoing humanitarian crisis occurring in Ukraine, U.S. Immigration and Customs Enforcement (ICE) has paused repatriation flights to Ukraine. ICE will continue to monitor the ongoing situation and make operational changes as necessary.”

90 Day Fiance’ Spoilers – K-1 Visa Requirements

When 90 Day Fiance’ contests apply for a K-1 visa to marry a foreign citizen they assume the responsibility for that person for life unless the individual leaves the United States. Per the Affidavit of Support, “Under Form I-864, the Affidavit of Support, a U.S. citizen or permanent resident promises to the government that they will be able to support the foreign national family member who is the beneficiary of their visa petition. This means that they can provide financial support at 125 percent or more of the poverty level in the Federal Poverty Guidelines until the foreign national gains U.S. citizenship or accumulates 40 work quarters, which amounts to about 10 years of work. If neither of those events occurs, the U.S. citizen or permanent resident will be responsible for supporting the foreign national for the rest of their life or until they permanently leave the U.S.”

90 Day Fiance Spoilers –  Deportation After Divorce

What is the process of deportation if a marriage doesn’t work out? What happens if the couple splits up before a green card is obtained? If the couple divorces before they have been married for two years, the foreign spouse could face deportation. However, there are exceptions. The Good Faith clause could allow someone to stay in the United States if the divorce was of no fault of their own. The Extreme Hardship Clause could allow someone to stay if leaving the United States would cause extreme hardship on the individual. Also, there is a Domestic Abuse Clause that pertains to battery or extreme cruelty.

Will the Extreme Hardship Clause come into effect for everyone who is caught in the middle of this unrest? Could approvals be granted because of the declared crisis? Only time will tell what happens but it looks like Mike may not get rid of Natalie any time soon.
