Mattie (Lexie Stevenson) is impressed with Charlie’s (Noah Alexander Gerry) breakfast attempt. He says they have to stay positive for their parents, while bracing for the worst. Charlie feels Michael is a superstar but she reminds him that the judge is the ultimate decider.

Lily feels after what the kids have been through, all she wants is for them to have some happiness

Nate Tells Shauna To Follow Her Gut

Shauna explains her impossible situation with her impact statement. She wants to do right by Devon and Hilary, but no matter what she says won’t bring Hilary back; but she can says can affect the rest of Lily’s life. Nate meant what he said when he said she needs to follow her gut. Devon returns, wondering what is wrong. Shauna goes upstairs and Nate doesn’t want to impose but says Neil (Kristoff St. John) left due to complications Sofia had from her accident and needs Devon to focus only on today.

Nate Doesn’t Want Devon To Have Regret

Devon wants to know if Nate convinced Shauna to not give her statement in court; Nate said he was supporting a young girl who is wrecked with guilt and anxiety; trying to make her feel better. Nate says Devon should be angry and grief stricken but wonders if he has calmly considered the consequences of his actions because the judge is going to hang onto every word he says and will decide what his SISTER’s punishment will be. Nate doesn’t want Devon to walk out of the courtroom with regret.

.Shauna is sad to hear Neil is going through more stuff, she asks if Nate told Lily but he hasn’t. Devon comes down saying its time for them to go. Lily asks a quiet Mattie what is going on, saying she can talk to her, but they don’t say a word. Cane wraps his arms around the kids and Lily encouraging them. Lily says she will meet them in the car.

Lily Keeps A Brave Face On

Devon is talking to Christine when the Ashby family arrives to meet with Michael. Nate meets Lily and Cane, informing them that Sofia was admitted to the hospital and Neil went to be by her side. She shares that she is ready for this, promising the positive waves are coming from him and Neil. Shauna is told to sit with Devon and Christina, but she hugs Charlie first.

Christine Asks For The Maximum Sentence

Lily sits beside Michael and begins to panic, every noise and sound creeping her out. She continually looks back at Devon, hoping he will say something but he won’t even look at her. Christine demands the judge impose the maximum sentence while Michael agrees no crime should go unpunished but this punishment is glaring disproportioned to the crime and society will not benefit from her imprisonment.

Cane Makes A Statement

The Judge thanks Mr. Baldwin for his opening words and before they move onto the victim impact statements Cane is allowed to make a statement. He confesses that he knew about Lily running the red light, and ordered his teen son to lie about it, covering it up. He feels he is the one who did the wrong thing, not Lily. The court appreciates his candor.

Shauna Asks The Judge For A Miracle

Christine Blair has Shauna Nelson’s impact statement read first. She nods at Devon reading how Hilary was her role model, mentor and friend. Hilary made her a part of her family and showed her love, that no one has done before and now they are all hurting but no matter how hurt and messed up this.

She doesn’t want Mattie and Charlie to lose their mom like she lost Hilary and miracles are real things that actually happen and if your honor won’t come too hard on Lily today; a miracle can happen for her and her family today. Shauna knows Lily and her family will forever be grateful for that miracle as she is today. Devon nods at Shauna and Lily.

Devon Tells The Court About Hilary

Devon thanks the Judge for his opportunity to speak. He tells the court how much of an exceptional woman Hilary was, and the love of his life. He mourns her and the child they were meant to have. He never took for granted the second chance he got with Hilary. He hears a lot of people asking for his sister to get a second chance so Lily doesn’t face a second tragedy, and he understands why they are doing it; they are fighting for what they are believing in.

Devon Asks The Judge To Give His Sister The Maximum Sentence

Devon says, this isn’t about the one fight causing her to run a red light – this was about years of anger, hostility and resentment towards my wife, and took every opportunity to criticize Hilary and literally out loud how much she despised her and wished Hilary was out of my family’s lives for good. On the night of the accident, she got her wish because she was so focused on attacking Hilary’s character like she so often did, that she completely disregarded the safety of everyone in the car with her, but everyone she shared the road with.

There is a reason this is being referred to as vehicular HOMICIDE not vehicular ACCIDENT – its a felony, and settled in the court of law. I am here represented my wife and child and my sister needs to face the consequences, to the fullest extent of the law for the two irreplaceable lives.

Lily Expresses Regret & Remorse

Lily stands before the courts, expressing regret for her actions and consequences. For her remorse to Devon and deepest apology for driving when that angry and she knew better. She wishes she had been able to accept her as the woman in Devon’s life over those years, as it was such a waste of precious time and is willing to do anything to have Hilary back into Devon’s arms and welcome their baby into their lives. She promises to do whatever it will take to make up for it and ask for her brother’s forgiveness.

Charlie Shocked By Devon

The Judge retires to his chamber and court is in recess until he makes his decision. Cane holds Lily as Devon looks on. Cane says he is proud of Lily for speaking from her heart. Mattie apologizes for leaving when it was so tough hearing what Devon had to say. Charlie wants to know what is wrong with Devon that he would still demand the harshest sentence after everything he heard.

The Judge Has Reached A Decision

Cane leaves the group to talk to Devon, who says he thinks he did what he felt was right. Cane wonders if Devon still feels the same now. Devon admits that he tried to forgive Lily but Cane reminds him what Neil did to Lily, locking her up in a boathouse and this isn’t over and there is still time. Devon looks at the family but the Judge returns, saying court is back in session and he has reached a decision!
