Days Of Our Lives Spoilers: Ben Informs Ciara His Legal Situation Just Got Worse

Days of Our Lives spoilers tease that Ben Weston (Robert Scott Wilson) will inform his girlfriend and staunchest supporter Ciara Brady (Victoria Konefal) that his legal situation just got worse, and he’s on Death Row the way it is with only one appeal left!

Days of Our Lives Spoilers – Ben Weston Is On Death Row For The Murder Of His Sister

Days of Our Lives viewers will recall that before the time jump, Ben arrived home to the gatehouse on the DiMera mansion property where he lived, to find his sister strangled with her own scarf! He had been concerned about break-ins when he earlier brought Detective Rafe Hernandez (Galen Gering) to investigate a window that was opened that he didn’t recall opening.

Apparently there was too much evidence against Ben to fight the charges, as Jordan Ridgeway (Chrishell Hartley) had Ben’s modus operandi as the Necktie Killer all over her, plus his DNA on the scarf since he was so in shock when he found her he didn’t think to touch anything. The forensic evidence against him had to have been overwhelming!

Plus, only about a week before he had gone to Victor Kiriakis (John Aniston) and tried to talk him into putting a hit out on Jordan to protect Ciara! Prior to that, Victor had tried to get Xander Kiriakis (Paul Telfer) to kill Ben! Ben and Ciara’s theory is that Victor had Xander kill Jordan and frame him for the murder, that way Ciara was safe from both Jordan and Ben, who Victor perceived as a deadly threat against Ciara!

DOOL Spoilers – Ben Weston Got Into A Fight With Clyde Weston Trying To Protect Will Horton

As Days of Our Lives, viewers will recall, Ben got into a fight with his father, Clyde Weston (James Read) who had a knife, trying to protect his cellmate Will Horton (Chandler Massey) from him. Clyde was thrown into solitary but he may have thrown Ben under the bus in the process, getting Ben in worse trouble and possibly even taking his last opportunity for an appeal away from him.

One wouldn’t think that a prisoner could lose the right to appeal a conviction, but inmates have very limited rights once they have been convicted, and an appeal is considered a privilege, not a right. At least this may be true in Soapland prisons, although perhaps not in real life! But any bad behavior on an inmate’s part, even if it was justified, can cause their legal situation to get worse. In addition, the appeal could be denied and no appeals court will take place.

Days of Our Lives Spoilers – Concrete Evidence Will Need To Be Provided To The Court That Will Prove Ben Weston Is Innocent

Concrete evidence will need to be provided to the appeals court that will prove Ben is innocent; however, if he’s right to appeal has been taken away, then Ciara will need to find another way. The most common reasons to appeal a case include legal grounds such as improper exclusion or admission of evidence, incorrect jury instructions, lack of sufficient evidence to support a finding of guilty, sentencing errors, false arrest, juror misconduct, prosecutorial misconduct, and ineffective assistance of counsel.

Ciara would need to appeal based on new evidence and make sure that Ben would have a competent attorney who is experienced in criminal cases and overturning convictions. It is possible that even if he’s right to his last appeal has been denied, however, that the district attorney may look at the evidence that Ciara provides and speak favorably to the appeals court.
