The fate of Lyle and Erik Menendez ended up in the hands of California’s parole board. On Thursday, Erik received a denial in his bid for freedom. Read on to find out why.

Erik’s Parole Denial

According to Parade, Erik, age 54, appeared at his hearing via video from the “Richard J. Donovan Correctional Facility in San Diego.” After many hours of questions from two parole commissioners, he ended up being denied release. Apparently, the board recalled early housebreaking activity in the ’80s and also violations of prison rules involving a phone.

Shortly after the ruling, a spokesperson for the brothers released a statement. “While we respect the decision, today’s outcome was of course disappointing and not what we hoped for.”

The statement, which won’t help Erik Menendez for now, added, “Our belief in Erik remains unwavering and we know he will take the Board’s recommendation in stride.” The same statement also highlighted Erik’s remorse, growth, and the positive impact he’s had on others.

The statement also mentioned Lyle’s hearing, scheduled for Friday. “Tomorrow, we turn our attention to Lyle’s hearing.” The words probably won’t mean much to the two brothers because the board also described itself as “cautiously optimistic.”

Growing Public Interest

The hearing followed years of public discussion about whether the Menendez brothers would ever get parole. California Governor Gavin Newsom previously signed legislation that requires older inmates who have served long sentences to receive more consideration for release. As a result, the brothers’ legal teams saw the policy change as a hopeful sign.

The parole board, however, has the final say. Previous delays in scheduling hearings only increased the uncertainty and brought new media attention to the case. The Menendez case captivated the public since the 1990s.

A Complex Defense

A 1996 conviction for the murders of their parents, José and Kitty Menendez, in Beverly Hills, landed the brothers life sentences without the possibility of parole. During their trial, they claimed that years of abuse led them to kill in fear for their lives. Prosecutors, on the other hand, argued that greed was their real motive.

Over time, the public’s view of the case changed. Documentaries and new coverage gave more credence to the brothers’ claims of abuse. Advocates now point to the brothers’ decades of good behavior and rehabilitation as reasons for reconsideration.

What Happens Next?

While Erik will stay in prison after the Thursday decision, attention now turns to his brother, Lyle. Lyle’s parole hearing on Friday could hold just as much importance for the brothers’ future.
