FBI Says Baldwin Pulled Trigger In Rust Shooting
After a lengthy investigation, the FBI recently concluded that actor Alec Baldwin pulled the trigger on the prop gun that took Halyna Hutchins’s life last year. According to Newsweek, a legal expert is speculating about what might be next for the beleaguered actor as well as the larger investigation.
In October of last year, a prop gun used by Baldwin discharged on the Rust movie set, killing cinematographer Halyna Hutchins, and injuring director Joel Souza. Baldwin, for his part, has maintained that he wasn’t the one who pulled the trigger on the prop gun at that fateful moment, per NPR.
According to USA Today, recent FBI analysis of the revolver used by Baldwin at the time of the Rust shooting suggests that the prop gun was in working order and would not have discharged without being fully cocked and its trigger pulled.
Expert: FBI Could Move Forward With Grand Jury
According to Special Agent Jose Cortez, the FBI performed three accidental discharge tests on the prop weapon used by Baldwin to see if it could have discharged without the trigger being pulled. The unfavorable findings led to Baldwin receiving a lot of flak via social media on Monday.
Litigation partner at Salzano Lampert & Wilson, LLP, Jason Lampert, said he believes prosecutors have multiple options as the Baldwin investigation comes to a close.
“They can continue to work with Baldwin’s attorney and have Mr. Baldwin proffer, or if the prosecutors believe they have enough evidence to proceed with an indictment, they can move forward with a grand jury proceeding.”

Disparity Screams Consciousness of Guilt
In a report on Monday, the New Mexico Office of the Medical Investigator stated that the Rust shooting was an accident. This report came to the conclusion that there was “the absence of obvious intent to cause harm or death” as well as “no compelling demonstration” that the prop weapon was intentionally equipped with live rounds on that fateful day.
However, according to Bradley Cohen, a criminal lawyer and firearms instructor, the incongruity between the story told by Baldwin and the one sussed out by the FBI “screams consciousness of guilt” on Baldwin’s part.
“Common gun safety in any circumstance, let alone pointing a firearm and pulling the trigger, is to check the firearm,” Cohen said, adding, “Actors don’t suddenly become less responsible because they are actors. If this was a rap video, charges would have already been filed.”
